© besider taggers names?
From: Booo© (Original Message) Sent: 1/03/2005 1:32 PM
Lately I have heard of more and more groups saying taggers cannot put a © beside their name. Is there a reason for that? Don't artists like to see it?
Am asking so's I can update my own group rules. Personally I don't like to add my name to tags and have never done that, but I need to know if I should be updating my group rules.
Hope this is the correct place to ask. It's not exactly a question about artist copyrights, so if not let me know

I cant claim art that I didnt make...but...having said that... I dont delete tags if other members do it.

artists dont like it actually.
I read a rant by a well known, now gild, artist, where he went off about taggers *erasing his backgrounds adding a name and claiming copyright*
probably what helped to push him to join the gild...

I've never put ©myself on any of my tags either, and never would. I also agree that if i haven't made the entire thing myself, i shouldn't put any kind of rights on it. IMHO, the only © mark should the be artists. I do however think that you should put tag by, or made by etc, on the tags you make. For one, you should be proud of what you've done, and for me, if i've done something right or wrong, I'd like my 'mark' to be on it so I can claim it. I put Tagged by Beth on all of mine.

My 2 cents... I NEVER put ©Candice on tags where I use another artists work. Even if it's public domain or royalty free. I WILL put ©CB on tags where I've used my own photos that I've taken myself. I DO put tag'd by Candice on all tags I create with ©artist on the tag in a prominant spot. I think it's ok to get credit for being creative enough to create the tag. I don't hold the copyright to other artist's work but I do hold the copyright to my photographs.

Thanks for all input on this. I did change my rules so that any members doing psp cannot put ©tagger's name. They can have something along the lines of tagged by tagger's name though. I personally don't ever give myself credit. I'm probably leaving myself wide open to stuff I make getting stolen, but it's something I just never did. Possibly because for the first few months of having psp I taught myself and never even thought about creditting.

Ok, I got a reply for this one, I was told by Rob Carlos that you can not put © beside your name/nic/watermark, on other artist's works. You can put your watermark, and it is recommended that you do so your work can be identified, but it the artwork is © to an artist, then you obviously must put it for the artitst, it causes legal problems.
Here's a excerpt of what he wrote:
Also, I don't allow people to put a separate copyright notice of their own on my work. I've noticed that people are starting to do that, and it makes for artist's problems legally. Only my name (Rob Carlos) may be used with a copyright mark - © on my artwork.

You should put a distinctive watermark or 'Tagged by...' notice on any tag that contains images that require the original artist's © To not do so is to effectively say that the tag was created solely by the artist & not by you. Might not seem like a big deal to you but it could be for the artist.
Lets say you take a Brian Rood pinup, tube it by striping off the background & apply the tube to a background created by you. Now as a ©aware person you follow his TOU & credit him & his web site on your tag but include no mention that you created the tag. Now I, a prospective client of his, stumbles upon your tag &
A) Think its the greatest thing in the world & I want to by the exclusive rights to it & he has no idea what I'm talking about or
B) Think the whole composition is total crap & start re-evaluating if he is the right artist for me.

using a watermarks on tags you create is up to those creating them
But I personally think using a © mark should only be usd for the purpose of naming the artist of the work because not all people realize who the artist is with more than one © symbol on an image so unless you actually drew it you should never put a copyright on an image unless it is of that artist
If you want to put tagged by or such that's up to individuals
I very very rarely add a watermark

I always watermark everything now and people still take that off too. I never place a copyright symbol next to by name.
Reasons behind this
1)This way if I do anything wrong the artists is not blamed
2) I also think this is a good way to keep track in case only a handful of people have written permission from an artist.
3) Also I have been spotting my tags all over My Space. Some with my nickname removed.I also now make a very small copyright of the actual artist and place it somewhere on the art it self. You can lower the opacity too. I know people can remove this too but others can usually see a slight smudge in that area if it is removed..
4) I am now also starting to write used with written permission on non online permission artists tags.

I have read this thread from the beginning and it makes for interesting reading all the differing opinions.
One thing I did notice is that there seems to be some confusion over the difference between © and a watermark.
© is solely reserved for the original artist of the tube/image/photo/drawing/painting you are using to make your tag. If ytou yourself made it from scratch totally with either pen/pencil/paper/paints/camera/graphics program then you have every right to use the © mark
Watermark is what you choose to put on your tag to identify it as one that you made - i.e. tagged by Tee/ TeeTag etc or a semi transparent image/ding etc with your initials/name or some other identifying mark.
