Tube Question - Anne Gerdes

I'm not sure where to ask this.
Ok I looked through the pages of "stoopid" questions and I don't see anything about Anne Gerdes.

Can we use her tubes?
I thought that if they were tubed by her that we couldn't.
They have to be her own art, right?
She states that the tubes are hers originally OR public domain.

They are Victorian tubes.

A lot of her stuff is from recently published Christmas cards, knick knacks and Christmas ornaments. Notably her angels are identical to a bunch of cardboard cut out Christmas ornaments that I bought at the Smithsonian about 10 years ago. One of her Angels is identical to a molded plastic orniment that I bought at the same time -- the Originals of these are in the Smithsonian collection. While the original piece of art is no longer under copyright --the post cards, Decorations, etc, are not. Ex -- the Mona Lisa is public domain, meaning the original artwork is not copyright -- but any post cards, photographs, or posters are copyright to the photographer or publisher.

And, just for the record -- those are not "Victorian Santa's -- Those are 20th century Santa's

Ok, I understand that but can we use them?

I assume that this situation is like the old CCD site where she had bunches and bunches of tubes that were just tubed by her and then she got rid of them and was using CCD Scratch Heaven, or whatever, scratch tubes only, which were made by her.
We could use them.

So, we can't use them, right? CAuse they aren't made by her or am I wrong?

Sorry, but I'm just trying to understand this.

Hello there Susy & Welcome.

If a peice of art/drawing was not drawn ie pencil or PC program by the person who tubed them in their PC graphic program then the art does not belong to them so they canot © it & claim it as theres, they only manipulated the said Art.

The person who actuly drew/photographed (photo-with permission if required)
is the legal © holder.

By "manipulating said Art", do you mean tubing?

I hate to go on like this but can we use Anne Gerdes or not? wavey

Yes Susy "Manipulating Art" means anything you do with a peice of art work using a graphic's program.

Have you read TOU on Anne Gerdes site.
Are the images/art drawn by her & © to her?
anything she has personal drawn/tubed a personal photo (photo with permission if needed)

Then if its states in her TOU that you can use them
I would say yes...

Anne Gerdes is not on the Artist List here, or at the Zone, or at
Artists That Allow or anywhere that I know of.

I would copy her TOU to here but we are not permitted are we?

What I am trying to say is that she states in the first line of her TOU that the tubes are from HER original art OR public domain (which is not her art) and that we can use them... this sent up a red flag to me because it makes it sound like some of the art is not hers and that she just tubed them.....

then....

Judecat posted that her tubes are from Christmas cards and such and it confused me.

Sorry i couldn't answer earlier..i can read but can't post...

I can see you getting upset but please don't.The others are just trying to help you ok♥

Anne Gerdes is not the copyright holder of any of those images so NO you cannot use her images.She says in her TOU that they are public domain which basically means she found them on the internet and tubed them.I thought she was on our NONO list but we must've missed transferring her when we moved over.

If you are after safe victorian images try looking at DOVER....they have some really nice ones there that you can use.

Thanks, Raq, that's all I wanted to know.
I just started to get Dover so I'll check into it.

I was trying to be very patient and explain Anne Gerdes TOU's but all I wanted was a yes or no answer. lalala
